Trump admin plans to make it easier to deport illegal immigrants without a trial
July 22, 2019
The new policy is set to go into effect on Tuesday
The Trump administration is preparing to announce a new policy on Tuesday that will make it easier for authorities to deport illegal immigrants more quickly.
What are the details?
Expedited removal, which is a policy that has been in place since 2004, allows for U.S. immigration authorities to deport an illegal immigrant without giving them a hearing with an immigration judge, in certain circumstances.
Under previous law, U.S. immigration authorities could only use expedited removal if an immigrant was both detained within 100 miles of the U.S. border with Mexico or Canada, and if they had been in the U.S. for two weeks or less.
The new policy would modify these restrictions, opening up millions of additional immigrants to expedited removal.
The new guidelines authorize authorities to use expedited removal on illegal immigrants who have been in the U.S. for more than two weeks but less than two years. It only applies to immigrants who entered the U.S. illegally by land.
Instead of having an immigration judge weigh in on their cases, the decision of whether or not to use expedited removal would rest with an immigration officer. This officer has to be shown "that the alien has been physically present in the United States continually for the 2-year-period immediately prior to the date of the determination of inadmissibility."
What else?
On Monday, the Department of Homeland Security released a version of this new policy on the Federal Register. On Tuesday, a finalized version is scheduled to be publicly posted and will immediately take effect.
This new policy, the department said, would "enable DHS to address more effectively and efficiently the large volume of aliens who are present in the United States unlawfully, without having been admitted or paroled into the United States, and ensure the prompt removal from the United States of those not entitled to enter, remain, or be provided relief or protection from removal."
